Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Nocturne (the “Service”), operated by Nocturne Inc. By using the Service you agree to these Terms.

Accounts & property organizations

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account and within property organizations you own or administer, including members you invite.

Acceptable use

You agree not to misuse the Service. You will not:

• break the law or infringe others’ rights;
• attempt to access data or accounts that are not yours, or probe or bypass security;
• disrupt the Service or place an unreasonable load on it, including via automation; or
• upload malware or unlawful, harmful, or abusive content.

Moons

Moons are internal travel credits used only within Nocturne. They are not cash, have no withdrawal value, and are not a bank balance or investment. Moons may be earned when an offered stay is approved, placed on hold during a booking request, spent when that request is approved, or released when a request is declined or canceled.

Offering and requesting stays

You may only offer property and dates you are authorized to make available. You are responsible for keeping property details, availability, house rules, and booking decisions accurate. A booking request is not confirmed until the host approves it. Members are responsible for following the rules disclosed for an approved stay.

MVP access & future fees

The current MVP does not charge a membership or booking fee. Nocturne may introduce fees after the MVP; any fee will be disclosed before you are asked to pay it and will be governed by updated terms.

Declines & cancellations

Moons placed on hold for a declined request are released back to the requesting member. Other cancellation rules, if any, will be shown in the Service before a stay is confirmed.

Intellectual property

We and our licensors own the Service and its content. You retain ownership of the content you submit, and grant us the limited rights needed to operate and provide the Service.

Disclaimers & limitation of liability

The Service is provided “as is” without warranties of any kind to the fullest extent permitted by law. A counsel-reviewed production version of these Terms must define the applicable travel, property, and liability provisions before Nocturne is used for real-world stays.

Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to comply with law. On termination, your right to use the Service ends and we may delete your data subject to our retention obligations.

Governing law & changes

These Terms are governed by the laws of Miami-Dade County, Florida, without regard to conflict-of-law rules. We may update these Terms; material changes will be posted here with a new effective date, and continued use constitutes acceptance.
